Terms and Conditions for Sacred Lotus Dahabeya Boat

These Terms and Conditions (“Agreement”) govern the use of the Sacred Lotus Dahabeya boat (“the Boat”) provided by the Boat Operator (“Operator”) to the customer (“Customer”). By booking or using the Boat, the Customer agrees to be bound by these Terms and Conditions.

1. Booking and Payment:
   a. The Customer must make a reservation in advance to secure the booking of the Boat.
   b. A deposit or full payment, as specified by the Operator, must be made at the time of booking.
   c. The Operator reserves the right to cancel any booking if the payment is not received within the specified time.
2. Boat Usage:
   a. The Boat is only for the use of the Customer and their invited guests.
   b. The Customer must comply with all applicable laws, regulations, and guidelines while using the Boat.
   c. The Operator reserves the right to refuse service to any person for any reason.
3. Safety and Liability:
   a. The Customer acknowledges that the use of the Boat involves inherent risks and releases the Operator from any liability for personal injury, loss, or damage.
   b. The Customer is responsible for the safety of all individuals on board the Boat during the rental period.
   c. The Operator will provide safety instructions and guidelines which must be followed by the Customer and their guests.
4. Damage or Loss:
   a. The Customer is responsible for any damage caused to the Boat, including its equipment and facilities, during the rental period.
   b. The Customer will be liable for the cost of repair or replacement of any damaged property.
   c. The Operator reserves the right to charge the Customer’s credit card for any repair or replacement costs.
5. Cancellation and Refunds:
   a. Cancellations made by the Customer must be communicated to the Operator in writing.
   b. Refunds for cancellations will be subject to the Operator’s cancellation policy, as communicated to the Customer at the time of booking.
6. Changes and Amendments:
   a. The Operator reserves the right to make changes to the Boat’s schedule, itinerary, or terms and conditions due to unforeseen circumstances.
   b. The Operator will make reasonable efforts to inform the Customer of any changes in advance.
7. Governing Law and Jurisdiction:
   a. This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction where the Boat is operated.
   b. Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.
8. Entire Agreement:
   This Agreement constitutes the entire agreement between the Customer and the Operator and supersedes any prior agreements or understandings, whether written or oral, relating to the use of the Boat.
